e. "Content" refers to data or media in any form, including but not limited to text, photos, graphics, audio, and video.
f. USER CONTENT: All content submitted to House Radar or made available by users, collectively.
g. YOUR CONTENT: All content that you submit or make available, including but not limited to reviews, ratings, compliments, information, and invitations displayed as part of your profile.
h. HOUSE RADAR CONTENT: All content created or made available by House Radar.
i. THIRD PARTY CONTENT: All content created or made available by data providers who license data to House Radar for use on the site, or other parties other than House Radar or its users.
j. SITE CONTENT: All types of content, collectively.

3. Eligibility.

You must be at least 18 years old and a resident of the United States to use this site. If you use House Radar as an agent of any business entity, you must be an authorized representative of that business and you agree on behalf of that business to be bound to these Terms of Service. If you do not meet these eligibility requirements or if you do not have the authority to bind your company to these Terms of Service, you must not use this site.

4. Permission to Use.

House Radar grants you permission to use our site under the restrictions described in these Terms of Service. You may at times be exposed to indecent, offensive, inaccurate, objectionable, and/or content that is otherwise inappropriate. 5. Restrictions.

6. User Accounts.

To access certain features of House Radar, you may need to log in using a Facebook account. You will have to create a Facebook account to access these features if you do not already have one. You agree to keep your account password secure, and you accept responsibility for any activity associated with your account. You agree to notify us immediately if you know or suspect that someone other than you is using your account.


a. Personal Accounts" are accounts that you use for your own personal, non-commercial purposes. To ensure your credibility as a site contributor, you agree to provide accurate and complete information about yourself when creating your personal account. You may not create multiple personal accounts or provide another person’s e-mail address or impersonate another person in any way.

b. "Business Accounts" are accounts that you use solely for representing a business. You may be exposed to liability if (a) your content violates any third-party right, including but not limited to rights involving copyright, privacy right, publicity right, trade secret, patent, trademark, moral right, or any other right, intellectual or proprietary; or (b) your content contains information that is false or intentionally misleading, information that harms or exploits minors, defamatory information, information containing pornography or hate speech, unlawful information, or information that violates or encourages others to violate laws or regulations.

8. Content Permissions.

Your content may be displayed on House Radar, incorporated into other works, used for promotion, used to create derivative works, distributed, or used for any other lawful purpose. Others may also do the same in connection with their own websites or media platforms ("other media"). By posting your content or otherwise making it available, you grant irrevocable permission to use your content for any purpose and you consent to waive any moral rights, attribution claims, and assertions for your content. You also agree to grant access to your content to House Radar and users of other media in connection with their use of the site and any other media.

9. Content Uses.

We may remove or reinstate user content at any time and for any reason or no reason at our discretion. In particular, we may remove content that is determined to violate our Terms of Service or that we believe to be inappropriate.

You do not own rights or any entitlements to compensation for advertisements that run alongside your content or anywhere else on the site. Advertising manner, mode, and extent are subject to change without notice.

10. Unauthorized Access.

We strictly and expressly forbid unauthorized access to House Radar. We reserve the right to use any means necessary to prevent unauthorized access, including but not limited to mapping IP addresses, contacting your Internet Service Provider (ISP), and using technological or programmatic obstructions.

11. Investigations.

House Radar is under no obligation to monitor the site or its Content. However, if we believe a possible Terms of Service violation has occurred, we reserve the right to investigate, contact appropriate law enforcement personnel as necessary, and/or block you from the site. You agree that you will indemnify and hold harmless House Radar and all of its parents, subsidiaries, affiliates, related companies, licensors, partners, and suppliers, as well as the directors, employees, officers, agents, and representatives of each of these entities. The terms of this indemnification (hold-harmless) agreement include but are not limited to costs, liabilities, and legal fees from any demand or claim made by a third-party arising from (a) your Terms of Service violation, (b) your access to or use of House Radar, or (c) any infringement by you or a person using your account of any property, intellectual, or other right of any person or entity. You consent to cooperate with claims as House Radar, at your expense, reserves the right to assume exclusive defense and control of any matter in which you are required to indemnify us. We will make reasonable efforts to make you aware of any legal claim, action, or proceeding. You may not settle any matter without written consent from us.

18. Warranties, Disclaimers, and Limitations of Liability.

a. NO WARRANTIES OF ANY KIND, EXPRESS, STATUTORY, OR IMPLIED, ARE MADE BY HOUSE RADAR AS TO (1) SITE OPERATION OR FUNCTIONALITY, (2) THE IP RIGHTS, SAFETY, USEFULNESS, LEGALITY, QUALITY, COMPLETENESS, INTEGRITY AND ACCURACY OF ANY SITE CONTENT, WHICH INCLUDES, BUT IS NOT LIMITED TO THE ACCURACY OF BUSINESS INFORMATION AND REVIEWS LISTED ON THE SITE, AND (3) ANY SERVICES AND/OR PRODUCTS SOLD BY LISTED BUSINESSES. b. HOUSE RADAR DISCLAIMS ALL LIABILITY FOR ANY (1) DAMAGES, BE THEY RELIANCE, EXEMPLARY, INCIDENTAL, PUNITIVE, SPECIAL, OR INDIRECT, (2) PROFIT LOSS, (3) DAMAGE TO OR LOSS OF REPUTATION OF HOUSE RADAR OR ANY THIRD PARTY, (4) INTERRUPTION OF BUSINESS, OR (5) INFORMATION OR DATA LOSS.
c. ANY AND ALL LIABILITY FOR LOSS OR DAMAGE DUE TO THE USE OF THE SITE AND SITE CONTENT IS FURTHER DISCLAIMED BY HOUSE RADAR. USE OF THIS SITE IS DONE AT YOUR OWN DISCRETION AND RISK. f. SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF SOME WARRANTIES, THE LIMITATION OR EXCLUSION OF IMPLIED WARRANTIES, OR LIMITATIONS ON THE LENGTH OF A WARRANTY. IN THIS CASE, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU FULLY, BUT THEY WILL APPLY TO YOU TO THE FULLEST EXTENT OF THE LAW.

19. Miscellaneous.

a. This agreement overrides any and all other previous agreements between you and House Radar.
b. The Terms of Service contain the entire agreement between you and House Radar for all instances and types of Site use.
c. Either party's failure to exercise any right provided herein will not result in the providing of a waiver.
d. Both parties herein acknowledge that no reliance is placed on any direct or indirect representation contained in these Terms of Service.
e. In the event that any provisions found in these Terms of Service are found to be unenforceable or illegal, those provisions will be eliminated or limited to the minimum extent necessary to make them enforceable and legal.
f. These Terms of Service may not be interpreted as authorization of agency, employment, joint venture, or partnership. These Terms of Service do not give you authority to bind House Radar in any way.
g. You may not assign, transfer, or sub-license these Terms of Service without House Radar's written agreement. Any assignment made in violation of these Terms of Service will be void. House Radar reserves the right to assign or transfer the Terms of Service without restriction.
h. You agree that the State of California will govern any dispute regarding or involving House Radar without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in San Francisco county, California state, and United States federal courts.
i. Nothing contained in these Terms of Service gives rights or remedies to any third party, except where expressly noted.
j. Section titles within the Terms of Service are listed for convenience only; they have no contractual or legal effect.
k. House Radar reserves the right to make necessary changes to these Terms of Service. We will notify you of any such changes by posting the revised Terms of Service on this page with a list of changes. Notifications may also be provided to you through e-mail or regular mail, but this is not required. You agree to periodically revisit this page to read all changes. Subscription Types and Billing:
HUDforeclosed.com is an online subscription service providing its members with access to a comprehensive database of foreclosure property information and other related services.

At the time you registered, you agreed to a specific term of subscription. For example, the term may be monthly, quarterly, semi-annually or annually. The term of your subscription will automatically renew for indefinite successive renewal terms for the same period as the initial term unless terminated by you or HUDforeclosed.com. If you registered for a trial subscription, the initial term begins at the end of the trial period, unless you cancel during the trial period.

Trial Membership: You will have full access to the service for 7 days for a nominal trial fee. If you do not cancel the service during the trial period, you will be billed $49.60 exactly 7 days, on the hour, from the date and time you originally registered. YOUR ACCOUNT WILL CONTINUE TO BE BILLED MONTHLY UNTIL CANCELED.

Semi-Annual Membership: You will be billed $99.00, immediately upon registration. There is no trial with the semi-annual subscription. YOUR ACCOUNT WILL CONTINUE TO BE BILLED SEMI-ANNUALLY UNTIL CANCELED.

Annual Membership: You will be billed $179.00 immediately upon registration. You do not need to cancel your annual subscription, as you will only be billed one time.

Trial subscriptions are only available to first time customers of the HUDforeclosed.com service and cannot be combined with any other offer. You must have Internet access and a valid credit card or debit card ("Payment Method") to register for our service. Additionally, we reserve the right to modify, terminate or otherwise amend our offered subscription plans. If you choose not to cancel after the Trial your membership will automatically renew. The cost thereafter is only $49.60 for each additional month. This subscription is billed directly to your credit card and will automatically be billed until you cancel your subscription. If you decide you do not want the subscription, simply cancel your account during the Trial period and no further charges will occur.

If you used a credit card you may be subject to a PREAUTHORIZATION at the time you order. THE PREAUTHORIZATION IS NOT A CHARGE TO THE CREDIT CARD, AND IF YOU CANCEL WITHIN THE TRIAL PERIOD THE PREAUTHORIZATION AMOUNT WILL NOT BE COLLECTED. THE PREAUTHORIZATION MAY HOLD FUNDS AGAINST YOUR AVAILABLE BALANCE, AND YOU CAN CONTACT YOUR CREDIT CARD COMPANY FOR MORE DETAILS REGARDING PREAUTHORIZATIONS.

By using the HUDforeclosed.com service, you are expressly agreeing that we are permitted to bill you for subscription fees and any other charges you may incur in connection with your use of the HUDforeclosed.com service. As used in these Terms of Use, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method, including a checking account, where applicable. The subscription fee will be billed at the beginning of your subscription and on each successive renewal term thereafter unless and until you cancel your subscription. Click on the "My Account" link to see the commencement date for your next renewal period. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by e-mail.

At its sole discretion, HUDforeclosed.com can offer different subscription terms on its Web site and the membership fees for these subscriptions may vary.

Various Services and/or Content on the Web site, whether offered by HUDforeclosed.com, third-party Service Providers or others, could require additional fees.

Promotional Offers
From time to time, in HUDForeclosed.com's sole discretion, HUDforeclosed.com may offer a reduced membership fee, varying trial membership durations (if any) or different terms altogether, for a specified promotional period, to first-time or other selected customers. Terms of the promotional offer, including the promotional price and duration of the promotional price, may vary from time to time. Specific details of your offer not covered in these Terms of Use will be explained on the web page where you indicate your acceptance of the promotional offer.

Automatic Renewals
HUDforeclosed.com primarily charges a monthly subscription fee but other term time periods are available and apply to this agreement. Your HUDforeclosed.com subscription will be automatically renewed for successive terms unless canceled. We will bill the subscription fee to the Payment Method you provide to us during registration. Your subscription will automatically renew for successive terms, without prior notice to you, unless and until you cancel your subscription or we terminate it. You must cancel your subscription before it renews in order to avoid billing of the next term's subscription fees to your Payment Method.

Cancellation
You may cancel your subscription to HUDforeclosed.com at anytime, and cancellation will be effective immediately. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH SUBSCRIPTION PERIODS. To cancel, click the link "Cancel" on the "My Account" page and follow the simple instructions provided. You may also cancel by email or telephone during business hours. Please call us at 1.800.422.6021 from Monday-Friday, 6AM-6PM PST and Saturday-Sunday, 9AM-5PM PST.

HUDforeclosed Real Estate Professional Network ("REPN")
Participation in the REPN program and use of HUDforeclosed.com services constitutes the unconditional and unmodified acceptance of the REPN service noted herein.

For a monthly fee, payable in advance after a trial period, HUDforeclosed.com allows REPN Service Providers to purchase marketing and advertising space on the HUDforeclosed.com site on a nonexclusive basis. Service Providers purchase geographical areas based on postal zip codes known as your "Territory". Properties listed in the Territory will randomly display the profile of the REPN Service Provider who has purchased the applicable Territory. When a HUDforeclosed.com subscriber has accessed or clicked on a particular property in the Territory, the REPN Service Provider who has purchased that territory will have their profile displayed as a preferred service provider.

REPN Service Providers must submit valid contact, license and payment information when registering for the nonexclusive REPN program. REPN Service Providers hereby represent and warrant the accuracy of the information provided and the authority to enter into a legally binding contract with HUDforeclosed.com for the marketing services provided herein. Fees charged to REPN Service Providers for access to a Territory are subject to change on a monthly basis and are determined at the sole discretion of HUDforeclosed.com. All marketing service fees are payable in advance on a month-to-month basis and REPN Service Providers agree that the minimum service period is one (1) month. Termination shall occur and be effective on the first (1st) day of the subsequent month and all REPN service fees are non-refundable.
